- 3.1 We retain personal data for as long as necessary for the purposes described in this Policy. Account and course records are retained as needed to provide access and support. Order and accounting records may be retained for applicable statutory periods. Correspondence may be retained to resolve enquiries and establish, exercise or defend legal claims. Marketing contact data is retained while you remain subscribed; limited records may be retained afterwards to document consent or respect an objection to marketing.
3.2 We disclose personal data where necessary to provide our services, comply with legal obligations or protect legitimate rights, as described in Section 4. Where consent is legally required, we obtain it.
3.3 Where the EU GDPR or UK GDPR applies, the relevant legal bases are performance of a contract or pre-contractual steps (Article 6(1)(b)), compliance with legal obligations (Article 6(1)(c)), consent (Article 6(1)(a)), and legitimate interests (Article 6(1)(f)), subject to your rights. You may unsubscribe using the link in a marketing email or by contacting hello@danieldettwiler.com. Necessary account, purchase and service messages may still be sent.
4.1 LearnWorlds. Our website and online courses use the platform of LearnWorlds (CY) Ltd, Cyprus. LearnWorlds processes personal data on our behalf for hosting, account administration, course delivery and platform communications, including some promotional messages. This may include account and contact details, enrolments, learning activity and technical usage data. We remain the controller of data processed on our behalf; LearnWorlds acts as our processor under its Data Processing Agreement.
4.2 Mailchimp. We use Mailchimp, provided by The Rocket Science Group LLC d/b/a Mailchimp, United States, to manage mailing lists and send newsletters and promotional communications. Relevant data includes your email address, name where provided, subscription preferences and records needed to manage delivery and subscriptions. Mailchimp processes this data on our behalf.
4.3 Other recipients. Service providers involved in hosting, technical support and payment processing may receive the data necessary for their services. A provider acting for its own legally defined purposes may be an independent controller. Information about the payment service selected for a purchase is provided at checkout. We may also disclose data to authorities or professional advisers where legally required or necessary to protect our rights.
4.4 International processing. LearnWorlds is based in Cyprus and uses international subprocessors; Mailchimp processes data in the United States. Processing may therefore take place outside Switzerland. The providers publish further details about their subprocessors and transfer safeguards in their data processing terms. Transfers must comply with applicable data protection law, using recognised adequacy decisions or appropriate safeguards where required. Mailchimp states that it participates in the Swiss-U.S. and EU-U.S. Data Privacy Frameworks and provides standard contractual clauses as a fallback where required. LearnWorlds provides contractual safeguards for international transfers in its Data Processing Agreement. You may contact us for further information about the safeguards relevant to your data.

5.1 Idee und Klang Studio may, from time to time, expand or reduce its business and this may involve the sale of certain divisions or the transfer of control of certain divisions to other parties. Data provided by Users will, where it is relevant to any division so transferred, be transferred along with that division and the new owner or newly controlling party will, under the terms of this Policy, be permitted to use the Data for the purposes for which it was supplied by you.

We and our service providers are required to take appropriate technical and organisational measures to protect personal data against unauthorised access, loss, alteration and disclosure. No online service can guarantee absolute security. If an incident affects data processed on our behalf, we will coordinate with the relevant provider, assess the incident and comply with applicable notification and information duties. Hosting by LearnWorlds does not remove our statutory responsibilities or those of our providers.
